Weddings in Spain and Gibraltar – Legal Requirements

Your wedding is one of the most important and special days of your life. With its wonderful climate, competitive prices and easy access, Spain is a great place to celebrate your wedding in style.

The legal aspect of getting married in Spain varies from one municipality to another, but the basic documents remain the same for foreigners who want to get married in Spain. The following information is necessary to get married in Spain.

An original birth certificate (ie the long version)

Certificate of Residence (Registration)

Full Passport

Certificate of no impediment to marriage. This can be obtained from your local registry office or the Spanish consulate. You will need to check which one your particular town hall requires.

In your case, the original divorce certificate, which is the one with the color seal.

If applicable, original death certificate.

All documents in English must have the Hague Apostille and are available at the following address:

Office of Legislation

Foreign Communities Office

Admiralty Office

London SW1A 2LG

Telephone 0207 008 1111

The current fee for the Apostille is £19 per document. If you go there in person, this process takes about 2 days. If you send the documents by post it takes approximately 2 weeks and you need to send an extra £2 for return postage and packing.

Then, all documents must be translated into Spanish and submitted to the corresponding town hall at least 3 months before the planned wedding.

Catholics from any country can legally marry in Spain.

If one of the spouses is Catholic and the other is not, the marriage is still possible with a Dispensation, which must be requested from your Bishopric. Neither party can divorce. Please note that demand for Catholic churches is high, so reservations must be made well in advance.
